Ask the internet where pouches are legal in Europe and you get tables that disagree with each other, because most of them were written once and never rechecked against a moving target. Three countries have banned sales since 2023, one more banned possession itself in 2026, and several rulebooks are mid-rewrite.
This page is the tracker we maintain instead: every position below is dated, tied to the instrument that created it, and rechecked against the regulator or official record rather than another blog's table. When a country's position changes, this page is the one that changes.
One ground rule first. Pouches are adult products. Snus Watch is written for adult nicotine users: 18 and over in Europe and the UK, 21 and over in the US.
Why is there no single European answer?
Because the EU's Tobacco Products Directive was written before the category existed. It bans tobacco for oral use, snus, across the EU with a Swedish exemption, and it regulates cigarettes, roll-your-own, and e-cigarettes in detail. Tobacco-free pouches contain no tobacco, so they fall outside the directive's product definitions entirely.
That leaves a gap each member state fills itself, and they have filled it in opposite directions. Sweden wrote a permissive framework law. France used a health-code decree to prohibit the products. Germany never wrote a pouch law at all, so its food safety authority reached for food law instead.
A revision of the directive is a standing topic in Brussels, and the country explainers on this site track what it would change. As of October 2026, no adopted EU revision covers pouches, and nothing in this table waits on one.
The country table, as of October 2026
| Country | Position | The rule that matters | In force |
|---|---|---|---|
| Sweden | Legal, regulated | Act on Tobacco-Free Nicotine Products: 18 age limit, product notification to the Public Health Agency, health warnings, marketing restrictions | 1 July 2022 |
| Denmark | Legal, capped | Maximum 9 mg per pouch, flavours limited to tobacco and menthol, standardised packs of exactly 20 pouches, excise tax per mg of nicotine | Fully from 1 April 2026 |
| United Kingdom | Legal, being tightened | Tobacco and Vapes Act: sale to under-18s becomes illegal, vending machine and free-sample bans | 29 October 2026 |
| Spain | No pouch-specific rules in force, cap proposed | Draft royal decree proposes a maximum of 0.99 mg per pouch, notified to the EU and contested by member states; not law | Proposal only |
| Germany | Not legally marketable | Federal food safety authority (BVL) classifies pouches as food containing the unauthorised novel-food ingredient nicotine; enforcement varies by state | Standing position |
| Netherlands | Sale banned | Nicotine pouches prohibited from sale | 1 January 2025 |
| Belgium | Sale banned | Royal decree prohibiting the sale of nicotine pouches | 1 October 2023 |
| France | Banned outright | Decree 2025-898 prohibits import, sale, possession and use of oral nicotine products; licensed nicotine medicines exempt | 1 April 2026 |
The table covers the countries we have verified against primary sources. It is a tracker, not a census: positions for countries not listed here are added only once the underlying instrument has been read, not copied from another table.
What do the bans actually ban?
The three bans are not the same ban. Belgium and the Netherlands prohibit sale: the offence sits with the shop, and the product disappeared from legitimate retail. France went further and prohibited possession and use as well, which is why the French explainer on this site answers the traveller question differently from every other country: a can in your luggage is inside the French ban's scope, not just a can on a French shelf.
Germany is the odd one out. There is no German pouch ban because there is no German pouch law. The BVL's position is that a pouch is a food, nicotine is an unauthorised novel-food ingredient, and an unauthorised food cannot be placed on the market. Enforcement is a state matter and visibly uneven, which is why cans remain easy to find in German kiosks despite the position. Legal to buy and easy to buy are different claims, and Germany is where they split.
What about the caps and the almost-caps?
Denmark's 9 mg ceiling is the strictest strength rule in force anywhere in Europe, and it arrived as a package: the cap, the flavour limit, standardised packaging and a fixed pack size all sit in the same framework. The Denmark explainer walks through what it did to the Danish shelf, and the strength guide shows where 9 mg sits on the ladder the rest of Europe still sells.
Spain is the one to watch and the one most often misreported. The health ministry's draft would cap pouches at 0.99 mg per pouch, a level no commercial product meets, which makes it a ban wearing a cap's clothing. Spain notified the draft to the European Commission, seven member states and the Commission itself objected, and a later draft was reported to soften the figure to 4 mg. None of it is law. With no pouch-specific rules in force, standard-strength pouches remain on Spanish shelves as of this check; the site's register marks Spain's position unverified, and this row moves when an instrument is adopted.
Which pages track which country?
- France: the ban, explained, including the court suspension and the medicines exemption.
- United Kingdom: pouches under the Tobacco and Vapes Act, separating what the Act does from what it merely empowers.
- Denmark: the 9 mg cap and what it removed.
- United States: not Europe, but the other framework readers compare against, in FDA authorization, explained.
- Crossing borders with cans: travelling with nicotine pouches, built only from the positions verified here.
FAQ
Are nicotine pouches banned across Europe?
No. Three EU states ban sales (France, Belgium, the Netherlands) and France also bans possession and use. Most of Europe sells pouches legally under national rules, and Sweden, the largest market, regulates them under a dedicated 2022 law.
What is TPD3, and will it change this table?
TPD3 is shorthand for the expected revision of the EU Tobacco Products Directive. A revision could bring pouches into EU-level rules for the first time. As of October 2026 no revised directive covering pouches has been adopted, so every row in the table above is national law, and each country explainer flags the proposal stage separately from what is in force.
Why do other sites' tables disagree with this one?
Usually dates. Several widely copied tables still show France as a sales ban pending approval, Denmark without a cap, and the United Kingdom with no age law at all. All three positions moved in the last eighteen months. Every row here carries its in-force date so a stale row is visible as one.
Is snus covered by the same rules?
No. Snus contains tobacco, so it sits under the EU directive: banned for sale across the EU except Sweden, and treated separately in the UK and US frameworks. Pouches contain no tobacco, which is precisely why their rules are national and scattered.
Can I order pouches online from a country where they are legal into one where they are not?
Distance selling follows the destination country's rules, and several states ban cross-border distance sales of nicotine products outright. A legal shelf in Stockholm does not make a parcel to Paris or Brussels legal. Check the destination row in the table, not the shop's.
